Seasonal rental and vacation rental. Which one suits you best?

 When you get into property rental you may come across the term “temporary”, “holiday or tourist” and it is often thought that they refer to the same thing. However, we must clarify that they are two different types of rental and that they are regulated by different regulations as well. Whether you are looking to rent a property or want to offer your apartment, it is important that you know how each of these figures works in the real estate solutions market.

Definition of seasonal rental

The first is regulated by the Urban Leasing Law and is defined as the lease of urban properties that are used for housing or for different uses, for example, commercial, recreational, assistance, craft, teaching, professional, or any other activity. This is a type of flexible rental that allows the parties to freely agree on the cost of the rent, the duration of the contract, the works or repairs, etc.



Although it is a temporary rental, there is no specific maximum time in the legislation. A season is established as a period, for example, summer or winter, or whatever is required to complete the activity that motivated the lease in the first place. What is clear with this type of rental is that the tenant does not need the house as his habitual or definitive residence, but rather will occupy it for the period of time that the need exists.

It is common for temporary leasing to be requested by students or professionals who are going to do a master's degree, as well as by workers who are transferred to other cities than their main place of residence.

The vacation rental

On the other hand, a vacation rental is regulated by tourism regulations and is a lease that gives a home for your total enjoyment, which must be equipped and furnished for immediate use. Likewise, the apartment is marketed or promoted, for-profit, and through specific channels of tourist offer.

  • This rental has some specific differences:
  • The property must be located on residential land.
  • It is used exclusively as tourist accommodation.
  • It is promoted by platforms or companies of tourist services and accommodation reservations.
  • The house must be rented regularly.

In some autonomous communities, a period of time is established for the duration of the contract, usually no more than 31 days.

Taking into account what has been said, the main difference between one rental and another is the use to which the property is intended and not the period for which the contract is in force.



Keep in mind that any home can be rented under the temporary modality, but not all of them meet the requirements to be considered a tourist residence. The latter is usually offered with complimentary services such as cleaning, tenant care, laundry, etc. This is not so with the temporary lease.
